Terms and Conditions – Website Roaster

1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of Website Roaster, a software-as-a-service product operated by CVPK Digital Studio LLC ("Company", "we", "us", "our"), a limited liability company registered in New York, USA, with its principal office at 3164 21st St #1098, Astoria, NY 11106.

By using Website Roaster ("Service"), you ("User", "Customer", "you") agree to these Terms. If you do not agree, please do not use the Service.

2. Service Description

Website Roaster provides automated AI-driven website critiques ("Roasts") and detailed multi-persona analysis reports.

Our Service includes:

• Automated website scanning and AI analysis
• One free roast delivered via email (the "Free Roast")
• Optional premium one-off report ("Full Report") featuring 4 professional AI personas (CRO Strategist, UX Designer, SEO Analyst, The Empath)
• Personalized improvement recommendations delivered by email

The Service delivers insights for informational and educational purposes only.

We do not guarantee specific outcomes such as increased conversions, sales, or performance.

3. Eligibility and Account Access

• You must be at least 18 years old to use the Service.
• You must have the legal capacity to enter into binding contracts.
• You must provide a valid email address to receive your roast or report.
• You may not use the Service to analyze websites you do not own or control, unless you have authorization.

You are responsible for the accuracy of any information (including URLs and email addresses) you provide.

4. Plans, Payments, and Pricing

4.1 Free Roast

Each user is entitled to one free roast per unique website and email address.

The Free Roast includes a partial website critique sent to your email.

4.2 Premium One-Off Report

Users may purchase a Full Report (a one-time payment) that includes:

• Complete roast + full recommendations
• Insights from four AI personas
• A downloadable or emailed report

Pricing is displayed on the checkout page at www.websiteroaster.io and may change at any time.

4.3 Billing and Payment

• Payments are processed securely via third-party processors (e.g., Stripe).
• All prices are in USD and exclude taxes where applicable.
• Fees are non-refundable, except where required by law.
• Once the Full Report has been delivered, the transaction is considered complete.

4.4 EU/EEA Consumer Right of Withdrawal

If you are a resident of the EU or EEA, you may withdraw from your purchase within 14 days unless the Service has already been provided in full.

By purchasing and receiving your Full Report immediately, you agree that the Service begins at once and that you waive your right of withdrawal upon delivery.

5. Acceptable Use

You may use Website Roaster only for lawful purposes.

You agree not to:

• Submit websites you do not own or manage without permission
• Use the Service for phishing, data collection, or competitive intelligence
• Attempt to reverse-engineer or extract our models or prompts
• Interfere with the Service or exploit it for malicious purposes
• Publish AI-generated content under false pretenses without disclosure

We may suspend access for suspected misuse or abuse.

6. Privacy and Data Protection

6.1 Data Controller and Location

Website Roaster is operated by CVPK Digital Studio LLC, but data is processed and stored within the European Union (Sweden), in compliance with the General Data Protection Regulation (GDPR).

6.2 Data We Collect

• Email address (for delivery)
• Website URL and page data for analysis
• AI-generated insights and reports
• Transaction information for premium purchases

We do not collect sensitive personal data.

6.3 Data Use

We use collected data to:

• Generate and deliver your roast/report
• Improve our analysis algorithms
• Communicate service updates (opt-in only)

We do not sell or share user data with third parties for marketing purposes.

6.4 Retention and Deletion

• Website and analysis data are retained for up to 90 days for report access and quality review.
• Email addresses are retained for communication and compliance.

6.5 Third-Party Services

We rely on third-party processors for secure payments, hosting, and AI analysis.

Each processor complies with GDPR and maintains adequate data protection measures.

7. Intellectual Property

• All software, prompts, AI personas, and website content on Website Roaster are owned by CVPK Digital Studio LLC.
• You retain ownership of any website content you submit for analysis.
• You grant us a temporary, limited license to process and analyze your data for report generation.
• "Website Roaster" and its logo are registered or pending trademarks of CVPK Digital Studio LLC.

8. Service Availability

We strive for 24/7 availability but do not guarantee uninterrupted operation.

Temporary downtime may occur due to maintenance, AI provider outages, or network issues.

We are not responsible for damages arising from service interruptions.

9. Liability

9.1 Disclaimer

Website Roaster provides AI-generated insights "as is."

We make no guarantees about the accuracy, reliability, or impact of our recommendations.

9.2 Limitation of Liability

To the extent permitted by law, our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

We are not liable for indirect or consequential losses.

9.3 Indemnification

You agree to indemnify and hold us harmless from claims resulting from:

• Misuse of the Service
• Submission of unauthorized website data
• Violation of these Terms or applicable laws

10. Termination

• Free Roast users: Your access ends automatically after your roast delivery.
• Paid users: Your license to access your report continues until delivery and ends once the report is sent.
• We may suspend or terminate access if you violate these Terms.

Upon termination, we may delete your data after a reasonable grace period.

11. Compliance

You agree to comply with all applicable laws, including data protection, copyright, and consumer protection laws.

You warrant that your submitted website data does not infringe third-party rights.

12. Dispute Resolution

12.1 EU/EEA and UK Customers

These Terms are governed by the laws of Sweden.

You may bring legal proceedings in your country of residence or in Sweden.

12.2 US and Other Customers

For customers outside the EU/EEA, these Terms are governed by the laws of New York, USA.

Disputes shall be subject to the exclusive jurisdiction of New York courts.

13. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and us.
• Severability: Invalid provisions will be replaced by valid ones closest in intent.
• Force Majeure: We are not liable for delays due to events beyond our control.
• Assignment: You may not assign these Terms; we may assign them in case of sale or merger.

• Survival: IP, limitation of liability, and dispute resolution provisions survive termination.
